idPay

idPay payment system

The idPay payment system consists of two payment options that sellers can activate on their profile to offer to buyers. They are:

1. idPay Credit Card – Not Available yet
2. idPay EFT – Available to all sellers

2. idPay Paypal – Available to all sellers

2. idPay Moneybookers – Available to all sellers

investment diamonds reserves the right to remove any of these two payment options from a sellers profile if it is deemed appropriate to do so, in investment diamonds’ sole discretion.

Acceptance of idPay Payments

If you choose to accept payments via idPay (investment diamonds’ online credit card payment or EFT system) you agree to the following:

By signing up for the idPay Credit Card service or idPay EFT service, you appoint investment diamonds as your agent to process payments on your behalf in accordance with your instructions, subject to the terms and restrictions of this Agreement. investment diamonds will at all times hold your funds separate from its corporate funds, will not use your funds for its operating expenses or any other corporate purposes, and will not voluntarily make funds available to its creditors in the event of bankruptcy or for any other purpose. You acknowledge that:

(i) investment diamonds is not a bank and the Service is a payment processing service rather than a banking service; and

(ii) investment diamonds is not acting as a trustee, fiduciary or escrow with respect to your funds, but is acting only as an agent and custodian;

(iii) accepting idPay credit card payments, there is a flat payment-processing fee of 5% payable on all payments conducted through idPay;

(iv) investment diamonds reserves the right to recoup any bank charges from either the buyer or seller when cash deposits are made for idPay EFT transactions. investment diamonds will first attempt to recover the bank charges from the seller and if unsuccessful, the charges will be allocated to the buyers account;

(v) any funds received into a seller's account will first be offset against any fees incurred by the seller (example: success fees, enhanced fees etc) and therefore the amount to be paid out, when a payout request is made, could be less then the actual amount received.

Making Payments via idPay

If you wish to make a payment via idPay (investment diamonds’ online credit card payment or EFT system) you agree to the following:

You acknowledge that the seller has appointed investment diamonds as an agent to collect money from buyers on the seller’s behalf and that once payment has been made by the buyer, investment diamonds will pass these funds over to the seller. Users will have no claim against investment diamonds for payments made to sellers through the idPay payment system and hereby expressly indemnifies investment diamonds against any claims that might arise from using the idPay payment system.

You acknowledge that once payment has been made through the idPay system that investment diamonds cannot guarantee that the funds can be recovered or returned in a case where a seller is fraudulent. In such an event, the buyer will have to deal directly with the seller in order to recover any monies lost as a result of non-fulfillment of any sale transaction.

You acknowledge that:

(i) investment diamonds is not a bank and the Service is a payment processing service rather than a banking service, and

(ii) investment diamonds is not acting as a trustee, fiduciary or escrow with respect to your funds, but is acting only as an agent and custodian on behalf of the seller.

Risk of Reversal of idPay Credit Card and idPay EFT Transactions

When you receive a payment through the idPay Credit Card service, you have a choice of accepting it or rejecting it. If you choose to accept it you are not protected against a subsequent reversal of the transaction. In the event that the sender's transaction is reversed for any reason you will owe investment diamonds for the amount of the reversed transaction plus any fees imposed on investment diamonds as a result of the reversal. Examples of such a reversal include, but are not limited to, a credit card reversal by the sender of the payment and a reversal of the transaction because the sender of the payment was using a stolen credit card or unauthorised bank account.

In the unlikely event that a idPay EFT transaction is reversed by a bank for whatever reason, you will owe investment diamonds for the amount of the reversed transaction plus any fees imposed on investment diamonds as a result of the reversal.

investment diamonds will seek to recover the funds from you by debiting your investment diamonds account balance and, if there are not sufficient funds in your investment diamonds account, investment diamonds reserves the right to collect your debt to investment diamonds by any other legal means.

Prohibited Transactions

You agree that you will not use idPay to accept payment for illegal products or services, including but not limited to materials that infringe the intellectual property rights of third parties. You will not use the idPay service, the investment diamonds website or any of the services offered therein for any unlawful or fraudulent activity. If investment diamonds has reason to believe that you may be engaging in or have engaged in fraudulent, unlawful, or improper activity, including without limitation any violation of any terms and conditions of this Agreement, your access to the idPay service may be suspended or terminated. You will cooperate fully with investment diamonds to investigate any suspected unlawful, fraudulent or improper activity. You also agree not to use your investment diamonds account to sell securities, business opportunities, franchises, multi-level marketing, or for the pre-order of goods. You agree not to impersonate a investment diamonds User or a investment diamonds representative, or to request that a investment diamonds customer provide you with their password or other information to access their account.

Payment Limits

Payments of between R1 (One Rand) and R10 000 (Ten Thousand Rand) will be accepted through the idPay Credit Card payment system. These limits may however change at the discretion of investment diamonds.

There are no payment limits when making use of idPay EFT.

Payout Requests

In order to withdraw funds that investment diamonds is holding in custody for you, you are required to make a payout request from the idPay Payout Request page in the My investment diamonds Selling area of the investment diamonds website. The funds will then be transferred electronically to your designated bank account (South African banks only). Users have 1 (one) free payout in a calendar month for amounts below R3,000.00. Thereafter a R5.00 idPay transfer fee will be charged for any payout amount under R3,000.00. For amounts over R3,000.00 no idPay transfer fee will be charged. If a user has used their 1 (one) free payout and requests another payout below R3,000.00, the R5.00 idPay transfer fee will be charged. If a user has R5.00 in their account, the system will not process the payment if a idPay transfer fee is applicable. A user can also not request less than R5.00 as a payout.

Users will have a UI (user interface) where the banking details will be pre-populated with the last banking details entered. If not previously requested the banking details on file will be used, otherwise it will be left blank. The requester needs to make sure the banking details reflected are correct. investment diamonds will not be held responsible for incorrect banking details received for transfers.

The maximum payout amount allowed will be limited to the balance in a users account and the UI will not allow you to request more. Between the times the request is made and the actual payout, the system will take into consideration any fees charged to your account and decrease the payout amount accordingly (if necessary). Before the payout is affected, you can make changes to your initial payout request. If a new request is made, it will replace the previous unprocessed request. If a request is made after the payout, the system will limit it to the available balance again, taking into consideration the payout made already.

Please note - investment diamonds reserves the right, from time to time, to request identity and address confirmation documentation before a payout request is processed.

No Surcharges

Under Visa, MasterCard, Diners and American Express regulations, merchants may not charge a fee to the buyer for accepting credit card payments (often called a "surcharge"). You agree that you will not impose a surcharge or any other fee for accepting idPay Credit Card or idPay EFT as a payment method.

Processing

investment diamonds shall make reasonable efforts to ensure that requests for electronic debits and credits involving bank accounts and credit cards are processed in a timely manner. However, a number of factors, several of which are outside of our control, will contribute to when the funds are received. We make no representations or warranties regarding the amount of time needed to complete processing, such as delays in the banking system or the mail service, nor shall we be liable for any actual or consequential damages arising from any claim of delay.

Closing and Restricting Accounts

investment diamonds, at its sole discretion, reserves the right to close an account at any time for any reason, including but not limited to a violation of this Agreement, upon notice to the User and payment to the User of any unrestricted funds held in custody. investment diamonds, at its sole discretion, also reserves the right to periodically retrieve and review a business and / or consumer credit report for any account, and reserves the right to close an account based on information obtained during this credit review process.

Termination

investment diamonds, in its sole discretion, reserves the right to terminate this Agreement, access to its website, or access to the Service for any reason and at any time upon notice to you and payment to you of any unrestricted funds held in custody for you.

Security Features

investment diamonds strongly suggests that you use a web browser with 128-bit encryption. However, regardless of whether you use a web browser with security features, investment diamonds is unable to guarantee that data transmitted is secure and/or will not be intercepted by third parties.

It is the responsibility of the user to ensure that his password is strong enough and that it is not shared with anyone. Investment diamonds recommends that a password consist of at least 1 (one) special character and 7 (seven) alphanumeric characters and that it be changed every month.

Electronic Fund Transfer Rights and Error Resolution

It is very important that you contact us immediately if you believe your username and password has been compromised, or if someone has transferred or may transfer money from your account without your permission. It is also very important to ensure that your banking details are correct as investment diamonds will not be held responsible for making payouts to incorrect bank accounts when submitting your payout request.

You acknowledge that it is your responsibility to safeguard your password and that you indemnify investment diamonds against any claims whatsoever resulting from, but not limited to, unauthorized access to your account, unauthorized changes to banking details or payout requests to other bank accounts.

You can inspect your transaction history at any time by logging in to your account on the investment diamonds website. If your transaction history shows electronic funds transfers that you did not make or authorise, notify us at once.
You need to contact our offices by telephone if your account has been compromised as emails could be delayed for various reasons.

Miscellaneous Disclaimers

investment diamonds reserves the right to hold funds beyond the normal distribution periods for transactions it deems suspicious or for accounts conducting high transaction volumes to ensure integrity of the funds.

investment diamonds shall not be responsible for payments made to unintended Recipients or for payments made in incorrect amounts due to the input of incorrect information by Senders.

investment diamonds shall not be responsible for any fraud, deception or misrepresentations by Users, whether or not the User is Verified.

investment diamonds shall not be obligated to pay a User for any Payments for which investment diamonds has not been fully paid by the Sender's credit card issuer or bank, as applicable.

investment diamonds will not have any liability in connection with any unauthorised interception or use of data relating to you or the investment diamonds service; any inability by you to use or access the service or the investment diamonds website for any reason; any actions or transactions by an individual that uses your user name and password with your consent or knowledge; or any cause over which investment diamonds. does not have direct control, including problems attributable to computer hardware or software (including computer viruses), telephone or other communications, or Internet service providers.

In no event shall investment diamonds be liable (i) for damages caused other than by intentional misconduct or (ii) for any indirect, special, incidental, consequential or punitive damages whatsoever (including, but not limited to, damages for lost profits, disclosure of confidential information, or loss of privacy), arising out of or in any way related to your use of or inability to use the Service or the investment diamonds website, even if investment diamonds has been advised of the possibility of such damages. In no event shall investment diamonds be liable for any act or omission of any third party (such as, for example, any provider of telecommunications services, internet access or computer equipment or software) or any circumstances beyond our control (such as, for example, a fire, flood, or other natural disaster, war, riot, strike, act of civil or military authority, equipment failure, computer virus, or failure or interruption of electrical, telecommunications or other utility services).

investment diamonds reserves the right to require Users who receive payments through idPay and operate with high reversal rates or otherwise present a relatively high risk of losses to choose between closure of their investment diamonds account or entering into an additional agreement addressing such risks, which may include higher fees.

Verified User

On applying to become a Verified User on this Site you agree to:

Adhere to the investment diamonds Terms & Conditions at all times (including the investment diamonds Listing Policy).
You understand that investment diamonds has the right to remove your listings and suspend your investment diamonds account without refunding your Verified User registration fee. In particular, if your percentage positive ratings drop below 90%, you risk having your Verified user status revoked.
It is at the full discretion of investment diamonds as to whether your Verified User Registration is approved. If your registration is not accepted your registration fee will be refunded.
This agreement including the requirements, benefits and terms & conditions for Verified Users may change from time to time. If so, changes will be posted on this website, which will take effect immediately.
Should a buyer make a successful claim against you as a seller through the investment diamonds Buyer Protection Programme, you are liable for the full amount of the claim.
To secure your performance of this Agreement, you grant to investment diamonds a lien on and security interest in your account. In addition, you acknowledge that investment diamonds may setoff against any accounts you own for any obligation you owe investment diamonds at any time and for any reason allowed by law. These obligations include both secured and unsecured debts and debts you owe individually or together with someone else.
Once you have been approved as a verified user, you will have the option to accept payments by means of the idPay payment system. If you choose to make use of the idPay payment system you must also agree to the terms and conditions as per the idPay User Agreement.

1. Fees

:: Fees only apply to Sellers ::

At investment diamonds you can register, browse, search, bid on or buy items at any time, and with no charge. However, as a Seller when selling an item, you will be charged a Success Fee on successful sales only and in some cases a Listing Fee (e.g Priority Listing Fee).

1.1. Listing Fees

	1.1.1. Standard Listing Fee:	None.
	1.1.2. Enhanced Listing Fee:	You can optionally select to have your item(s) featured by creating enhanced listings. See the Fee Rate Card for detailed information on these fees. Please note - Enhanced Listing Fees are Non-refundable and are charged even if no sale took place.

1.2. Success Fees

The Success Fee only applies if you successfully sell an item on investment diamonds. You will be charged a Success Fee based on the Winning Bid Amount for your item(s).

Standard Auctions

See the Fee Rate Card for detailed information on these fees.

Buy Now Items

If an item is purchased using the Buy Now function at the Buy Now Price, for the purpose of calculating the Success Fee this Buy Now Price corresponds to the Winning Bid Amount of a Standard Auction. Success Fees for Buy Now Items are therefore calculated in the same manner as Success Fees for Standard Auctions. Buy Now Items are only available to Verified Users

Personal Offer Items

As a seller you may optionally make offers to your runner up bidders at the amount they bid. If an item is purchased using the Second Offer function you will be charged a Success Fee based on the Second Offer Price corresponding to the Winning Bid Amount of a Standard Auction. Second Offer Items are only available to previous bidders on closed auctions as an offer initiated by the seller for a certain period no more than one month after the close of the item.

Items that are sold to runners-up

In the event the item is sold to the runner-up because the winning bidder defaulted, the Success Fee will be calculated using the Bid Amount of the runner-up's bid.

Here is how the Success Fee will be calculated:

If your item sold , your Success Fee is simply 6% of the Winning Bid Amount.
If you are a Power Seller or a Verified User, then the Success Fee will be 5% of the Winning Bid Amount.

Examples:

If you are a normal seller and your item is sold for R150.00 then the Success Fee will be 6% of R150.00 - i.e. R9.00.
If you are a Power Seller or Verrified User and your item is sold for R150.00 the the Success Fee will be 5% of R150.00 -i.e. R7.50

2. Invoicing

You will be invoiced once a month, on the first working day of every month, for the activity on your investment diamonds Account over the past month. An Electronic Tax Invoice/Statement will then be emailed to you.

You can view your investment diamonds Account status at any time by accessing your investment diamonds Account in the Member's area on the site.

3. Payments

There are two options for paying your investment diamonds fees:

3.1. Using your credit card on file.
3.2. Bank Debit Order.

IMPORTANT - By registering as a seller on our site you give investment diamonds permission to charge/bill/deduct any fees or amounts owed from your nominated bank account or credit card registered on the site.

Your credit card or bank account will be automatically charged / debited within 14 days of your Tax Invoice/Statement being issued.

You are responsible to ensure that there are sufficient funds for payment of your investment diamonds Account every month. It is therefore your responsibility to check your current investment diamonds Account balance from the Member's Area and request a Tax Invoice/Statement if necessary.

We require payment in full each month on investment diamonds Accounts. Failure to make a payment, causing your investment diamonds Account to become overdue, will result in your investment diamonds Account incurring extra charges. If your account is disabled or blacklisted due to non-payment, we reserve the right to charge a Re-activation fee of R50. Overdue investment diamonds Accounts will be charged interest at the current Nedbank Limited Prime interest rate from time to time and you could also be made liable for any legal fees incurred by investment diamonds on the attorney and own client scale including collection commission and tracing costs incurred. Your permission to sell on investment diamonds may be suspended for non- or part-payment of fees.

User to User Transfers - Not Available currently

If your investment diamonds user account has a credit balance you may use this to make payment or part payment to another investment diamonds user on our system. As a seller User to User Transfers received will be used to offset against any fees owing to investment diamonds.

4. Credits and Refunds (including SNC's - Sale Not Completed)

Credits are applicable for Success Fees only (Listing Fees and Enhanced Listing Fees are non refundable), and may be issued at the discretion of investment diamonds in the following cases:

The Buyer has not responded to your attempts to contact them during a period of 7 days after the end of the auction or buy now sale.
The Buyer does not fulfill the deal (this includes the Buyer backing out or not paying, having a financial or family emergency, or claiming that the terms of sale are unacceptable).
The Buyer's payment fails (this includes the Buyer's cheque bouncing or the Buyer stopping payment going through for some reason).
The Buyer returns the item and you refund the money.
The actual sale price is lower than the highest winning bid amount.
One or more of the Buyers back out in a multiple quantity auction or buy now.
The item is sold to the runner up because the winning bidder defaulted.

Credits can only be claimed 7 days after the close of the auction or buy now sale, and no later than 60 days after the close of the auction or buy now sale. Before you can claim a credit, you must have attempted to contact the Buyer at least 3 times via email. (We may request you to forward these emails to us at any time, so please save copies of them.) To claim a credit, you will need to use the File a SNC Alert Wizard. Please Note - should you retract an SNC Alert you are still liable for paying the Success Fees for that particular transaction as we then deem the transaction to have been concluded or payment received.

If your credit request is successful, a credit will be made to your investment diamonds Account within 14 days of your credit request being approved. A refund can then be requested. Refunds will not be given for any complimentary credits to your investment diamonds Account.

Listing

In order to promote a safe, fair and enjoyable trading experience for all users, investment diamonds has established a set of listing policies.

This Listing Policy is mentioned in clause 4.4.4 of the Terms and Conditions of Use of this Site and must be adhered to by all users:

1. The following policies apply to all listings and are strictly prohibited:

1.1.	Misrepresentation of items including:

1.1.1		Creating titles and descriptions that do not accurately describe the item for sale.
1.1.2.		Inappropriate use of brand names or other words for the purpose of attracting buyers.
1.2.	Anything that attempts to circumvent paying investment diamonds fees (e.g. selling a list of prices, selling a catalogue, cross sell or up selling). This includes listing items with nominal amounts in order to circumvent paying investment diamonds fees, get contact details from the buyer, and advertise items for free or to increase positive ratings. Nominal amounts include 1c, 10c, R1 or any value that investment diamonds deems to be nominal.

1.3. Listing an item that requires an additional purchase, swop or trade in.

1.4. Listing of items where the seller is not physically in possession of the goods for sale (for example listing an item as a "pre-order" or where the seller's shipment has not yet arrived). This excludes sellers operating on a "drop ship" or consignment basis where the seller has a proven track record and an established relationship with a supplier that ships directly to their buyers. Permission needs to be obtained from investment diamonds and approval is entirely at the discretion of investment diamonds.

1.5. Listing of items soliciting entries for a competition or charitable donations.

1.6. Listing of items in inappropriate categories.

1.7. Listing of multiple items that are the same or similar items that could be listed as a single listing.

1.8. An offer to give away a product or service for free (including the option to subscribe to a mailing list).

1.9.	Bidding on your own items (including having friends, family or acquaintances bid on your items in an attempt to artificially inflate the price).

1.10. Including unreasonably high shipping costs in item listings.

1.11. Use of profanity or offensive language.

1.12. Specifically you may not list items that fit into the following categories:

1.12.1	Stolen goods.
1.12.2	Illegally imported goods.
1.12.3	Banned substances and pharmaceuticals that require a prescription according to South African law;
1.12.4	Pirated or counterfeit goods of any nature, including software, movies, music, clothing, replica watches or any item that would infringe on copyright or trademark laws;
1.12.5	Goods and services that could by nature be deemed to be harmful or dangerous, to persons or property either directly or indirectly;
1.12.6	Goods and services of which the sale or export would be in contravention of any law; and
1.12.7	Goods or services that according to investment diamonds's sole discretion may be deemed to be inappropriate for sale on this site.

1.13. No shipping or handling fees are to be charged on electronically distributed products.

1.14. investment diamonds may at it's sole discretion remove any items from the site for any reason whatsoever.

1.15. Listing abuse, manipulation and excessive listing on investment diamonds.

In order to create a fair and level playing field, and provide an enjoyable and safe experience for buyers, sellers may not manipulate or abuse the listing service to get items featured more regularly, prominently or spam the investment diamonds website with multiple product listings. This is entirely at the discretion of investment diamonds and will be monitored on a case by case basis.

This also includes but is not limited to: repeated multiple relisting with short durations, keyword spamming, spamming categories with multiple items (with the same or similar items), and listing in the wrong categories. Users found abusing the system will be given a warning first, thereafter, if this activity continues, the seller will be charged an excess listing fee of R0.10 per listing on their listings over and above their free listing allowance. The free listing allowance will be calculated as the greater of:

100 listings per week (calculated from Sunday to Saturday).
The maximum number of sales by the seller in any one week period over the past 6 weeks multiplied by 5.

1.16. Listing of Nazi related items

The following may not be listed:

Items or memorabilia displaying Nazi / Nazi-related icons, emblems and symbols, including Nazi SS, 3rd Reich and swastika.
Items, documentation or any matter promoting violence, hatred, racial prejudice or religious contempt.

The following items may be listed:

German World War II memorabilia that does not exhibit emblems, symbols or icons referring to the Nazi's (as indicated above).
German stamps and coins produced during the World War II period.
Books and documentaries detailing world history and events revolving around the World War II time period (which may exhibit imagery referencing Nazi's, the Nazi SS or the swastika).

1.17. Listing of South African coins and notes that do not comply with the South African Reserve Bank Act 90 of 1989.

In particular, the following items are not allowed in the South African coins and notes category and users that list any such items will be guilty of an offence and could face possible imprisonment in terms of the South African Reserve Bank Act 90 of 1989:

Any coin or note of the South African Reserve Bank that has been forged, altered or unlawfully issued or any coin or note that purports to be from the South African Reserve Bank.
If a user without the authority of the South African Reserve Bank, engraves or makes upon any material whatsoever any words, figures, letters, marks, lines or devices the print whereof resembles in whole or in part any words, figures, letters, marks, lines or devices peculiar to and used in or upon any note of the South African Reserve Bank or any coin which is legal tender and then lists that item on the investment diamonds website.
Listing images of South African currency that does not have the words “Image - Not legal tender” printed diagonally across the image.

Please refer to the specific requirements for listing South African Coins and Notes.

1.18. Sellers may not offer lay-bye's as a payment option to buyers.

1.19. Charity auctions and requests for donations may not be listed without the prior consent of investment diamonds, you will need to provide the charity's NPO or Fund Raising number, including a letter from the charity confirming that you may collect funds on their behalf.

2. The following policies apply to all listings except those that do not incur Success Fees:

2.1.	No external links are permitted (i.e. links other than those on the www.investment diamonds.co.za domain) except when linking to a manufacture's web site e.g. linking to Nokia's web site for more information on a specific model of cell phone for sale.
2.2.	No contact details of any sort (including telephone numbers and email addresses) are permitted in the description or in responses to questions from the Q & A facility, this includes advertising your business or services even if no contact details are included.

3. The following policies apply only to listings that do not incur Success Fees e.g. Classified listings and certain Auctions / Buy Now listings in the Property and Auto categories (see the Fee Rate Card for listings that do not incur a Success Fee):

3.1. Listings may include links to other third party web sites.
3.2. Listings may include contact details of the seller.

Violation of this policy may result in a range of actions, including listing cancellations, suspension of your investment diamonds account and forfeiting of investment diamonds fees on cancelled listings.

Information Collection and Use

When we collect personal information about you we will collect this information from you lawfully and fairly and not in any unreasonably intrusive way. You acknowledge and agree that we may collect this information from you in connection with or as a consequence of your use of our site, including, without limitation, the supply of the online trading services to you.

We are the sole owner of the information collected on this site. We will not sell, share, or rent this information to others in any way other than as disclosed in this privacy statement.

We collect information from our users at several different points on our site. We collect information about your bidding, buying and selling activities if you choose to participate on our site as a result of you engaging in these activities, and also from ratings and comments received from other users regarding you engaging in those activities. We also collect information from any form of correspondence, such as emails and telephone conversations, from you or from a third party about you. We may also collect information from you if you choose to partake in special promotions with third parties on our site. This information will be shared with that third party, but only with your consent and for the purpose of that promotion.

We will also collect financial information about you if you choose to bid for certain goods and services on our site, if you sell on our site, and also as set out in the Terms and Conditions of Use of this Site. We do charge fees for selling, and your payment information will be used to charge you accordingly.
